End-User License Agreement (EULA)

This End-User License Agreement (“Agreement”) is a legal contract between you (“User,” “you,” or “your”) and Really Slow Motion LLC, doing business as Levitate With Sound (“we,” “us,” or “our”) regarding your use of our products, services, and any related materials (“Products”). By downloading, installing, or using our Products, you agree to be bound by the terms of this Agreement. If you do not agree, do not use our Products.
This Agreement is subject to and should be read in conjunction with our Terms and Conditions, which govern the general use of our Services.
1. License Grant
1.1 Scope of Use
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Products solely for personal or business purposes, in accordance with the terms of this Agreement. This license permits creative use for original musical or audio compositions in commercial or personal projects, but does not authorize reuse or redistribution of any source content outside the scope of this Agreement.
1.2 Personal Use and Device Limitation
This license is personal and non-transferable. If purchased by a business or organization, it must be assigned to a single designated individual for exclusive use. Licenses may not be resold or listed on secondary marketplaces, including forums, resale platforms, or classified ads. Each licensed user may install the Product on up to two devices (e.g., desktop and laptop), provided both are used solely by that individual and not simultaneously by others. Unauthorized transfers will result in license revocation.
1.3 Bundles and Backups
Products offered as part of promotional bundles are licensed individually and must be used by the same authorized user. You may create a reasonable number of personal backups for archival purposes. These may not be shared, distributed, or used to circumvent licensing terms.
1.4 Activation and System Requirements
Upon purchase, you will receive a unique serial code for activation through Native Access by Native Instruments, which requires an internet connection. To use the Product, you must have a compatible version of Kontakt or Kontakt Player, as specified on the product page. You are responsible for verifying compatibility before purchase. We are not responsible for issues resulting from missing software or version incompatibility.
1.5 Delivery Platform
Products are delivered exclusively through Native Access. We are not responsible for delivery errors, installation issues, or external platform functionality.
2. Usage and Restrictions
2.1 Permitted Use
You may use the Products in original music, sound design, and media production projects, both personal and commercial. This license does not permit reuse or redistribution of source materials as standalone assets or in derivative products.
2.2 Prohibited Uses
- General Misuse: Unauthorized distribution, sharing, sublicensing, reverse engineering, or bypassing of licensing controls.
- Unlawful or Harmful Use: Inclusion in content that promotes hate, abuse, discrimination, or violates third-party rights.
- AI/ML Restrictions: Use in training datasets, machine learning models, or generative AI systems, unless explicitly authorized.
- Derivative Works: Creation of new sample libraries, soundpacks, virtual instruments, or tools that embed or repackage our content in whole or part.
Violation of these terms may result in license revocation, serial invalidation, and legal action.
2.3 Public Demos and Attribution
You may reference and demonstrate the Products publicly (e.g., reviews, portfolios, tutorials), provided the usage is non-misleading and does not imply endorsement. Demonstrative use of unaltered audio is permitted but must not be redistributed. Misrepresentation may result in takedown or enforcement.
3. Ownership and Intellectual Property
All intellectual property rights in the Products are the sole property of Really Slow Motion LLC. This Agreement does not grant ownership or any rights beyond those specified. Unauthorized use constitutes a violation of applicable law.
Where contributors or collaborators are credited, all associated content remains fully owned by Levitate With Sound. Credits do not imply shared licensing or separate usage rights.
4. Product Updates
Licensed users may receive updates or enhancements at our discretion. Updates are subject to the same license terms and do not constitute a new license. You will be notified when updates are available for re-download through Native Access. If a product is discontinued, users may continue to use their current version but will no longer receive updates, support, or downloads. You are responsible for maintaining your own backup.
5. Customer Support
Support is available via info@levitatewithsound.com for legitimate license holders. While we aim to assist, support is not guaranteed and may be limited based on license status or misuse.
6. Disclaimers
- We do not guarantee the Products will meet your specific needs or function without error.
- Use of the Products is at your own risk. You assume full responsibility for usage and outcomes.
7. Limitation of Liability
- We are not liable for direct, indirect, incidental, or consequential damages, including lost profits, data, or compatibility issues.
- Our liability will not exceed the amount paid for the Product.
8. Termination
This Agreement may be terminated if you violate any terms. We reserve the right to revoke licenses, invalidate serials, and deny further access in cases of breach, fraud, piracy, or chargebacks. Upon termination, you must cease use and destroy all copies.
9. Modifications to This Agreement
We may update this Agreement at any time. Continued use after such changes constitutes acceptance of the revised terms.
10. Governing Law and Dispute Resolution
This Agreement is governed by the laws of California. Disputes shall be resolved through arbitration or local courts, unless otherwise prohibited by law.
11. Entire Agreement
This Agreement represents the full understanding between the parties. If any part is unenforceable, the rest remains in effect. In case of conflict with other terms, this Agreement prevails as to the licensed Products.
By using our Products, you acknowledge that you have read, understood, and agreed to this End-User License Agreement.
